Under the current regime, permitting risk and uncertainty has been the Achilles heel of the pipeline infrastructure industry, bringing new project development nearly to a stand-still. Opponents of energy infrastructure have mastered a playbook of gaming the environmental review and judicial system to stop projects. The prospect of these obstacles discourages operators from investing in the design, engineering and site work needed to even submit a permit application.
